These terms apply to theory test booking packages purchased on Driving Theory 4 All. If you purchased a theory training subscription on its own, without a test booking, your purchase is covered by our terms of use instead.
Full terms:
1. All software and services provided by Theory Training Solutions Ltd (the company) are on an "as is" basis with no warranties of any kind. This does not affect your consumers' statutory rights.
2. "the company" grants you a non-exclusive, non-transferable, royalty-free, limited licence to use the binary form of the software provided by "the company". Redistribution of programs owned by "the company", unless explicitly granted by "the company", is strictly prohibited.
3. All content included on this site, including text, graphics, logos, button icons, images and software, is the property of "the company" or its content suppliers and is protected by international copyright laws. All programs used on this site are the property of "the company" or its software suppliers and are protected by international copyright laws. Any attempt at reverse engineering, disassembly, or decompilation of programs, unless it is explicitly permitted, is prohibited by law.
4. "the company" may send notices to you via either email or regular mail. "the company" may also provide notices of changes to the terms or other matters by displaying notices or links to notices to you generally on the services provided by "the company".
5. While it is not "the company"'s intent to monitor your online communications, "the company" reserves the right to edit or remove content that we become aware of and determine to be harmful or offensive to the general public. Termination or suspension of your account may result as a consequence of violation of this rule.
6. The integrity of this system relies on proper use of email as a message passing media. The use of the email system, directly or indirect as a spamming tool, or other than it is intended, is prohibited.
7. "the company" reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the services (or any part thereof) with or without notice. In the case of permanent discontinuation of service all customers with unexpired subscriptions would be entitled to a full refund of our service charge, excluding any monies passed to the Driver and Vehicle Standards Agency for a test booking as any such test would still stand. "the company" will not be liable for any consequences or losses arising from our site becoming unavailable for a period of time due to circumstances beyond our control; such circumstances may for example include telecommunications problems or data centre environment problems. Any customers unable to complete their Pass Protection or Pass Protection Plus requirements prior to their tests due to service unavailability would be entitled to a full refund of our service charge, excluding any monies passed to the Driver and Vehicle Standards Agency for a test booking as any such test would still stand.
8. You are expected not to use the services provided by "the company" for any unlawful activities not otherwise covered above, including but not limited to, attempting to compromise the security of any networked account, a site or a country. Appropriate legal procedures will be pursued when "the company" is aware of any of these activities.
9. Sharing of user accounts is not permitted nor is the publication of user names and passwords on other web sites. Any user who is found to violate this rule will immediately have their account suspended without recourse to refund of any monies previously paid to "the company".
Our booking service allows us to book a car or motorcycle theory test with the Driver and Vehicle Standards Agency (DVSA) on your behalf. Every booking package also includes a subscription to our theory training material, with full support, which remains valid until the date and time of your test.
We are not part of the DVSA. We are an independent company acting on your behalf, and we will match your requested test centre, dates and times as closely as availability allows. The price you pay covers the DVSA test fee plus our service fee, which varies by package and includes VAT at the standard rate. Our fee covers the management of your booking, your theory training subscription with full support, the administration of your account, our communications with you, and eligibility for unlimited re-sits under PASS Protection Plus (see clause 11).
Bookings are normally placed shortly after we receive your payment, but please allow up to one working day for processing. Once your test is booked we will confirm your test details by email, and by text message if you have given us a mobile number, with a further reminder as your test date approaches. We cannot accept responsibility for emails that fail to arrive.
It is your responsibility to make sure the details you give us are accurate, and we cannot be held responsible for the consequences of inaccurate information. It is also your responsibility to arrive in good time for your test with the required documentation. Your details will only be shared with the DVSA and will never be passed to any other third party.
If you want to move or cancel your test after it has been booked, you can do so on the DVSA website at https://www.gov.uk/change-theory-test. The DVSA only accepts changes and cancellations up to three clear working days before the test, so for example a test booked for a Monday must be changed or cancelled by the previous Tuesday. Please tell us about any changes you make so we can update your training account to match. We cannot be held responsible if the DVSA moves the date or time of your test, or cancels it.
11. Unlimited re-sits (PASS Protection Plus) To qualify for unlimited re-sits you just need to score 90% or more in all of our topic tests and pass at least 10 mock tests before your actual test, to show us you are fully prepared. If you then fail your test after scoring at least 35 out of 50 in the multiple choice questions part and at least 40 out of 75 in the hazard perception part, send your original failure document to us for processing. Once we have verified your use of our site and your scores, we will book your re-test for you at a time to suit you, and we will keep doing so until you pass. We will also extend your access to our training material while you prepare for each re-test. You cannot claim a re-sit if you do not take your test, whatever the reason, or if your use of our site or your scores do not meet these criteria. 12. Refunds If you purchased a theory test booking package, you can request a full refund providing that:
- you ask within 14 days of the date of payment, and
- you have not used the theory training account included with your booking, and
- you have not taken your theory test and the DVSA is able to refund the test fee to us
If the DVSA test fee cannot be recovered and you have not taken your test, we will refund the amount you paid minus the DVSA test fee, providing you meet the first two conditions above.
Refund requests must be sent by email to support@drivingtheory4all.co.uk. When we receive your request we will email you a short refund survey, which must be completed and returned before your refund can be processed under this policy. This requirement does not affect your statutory rights.
Our maximum liability to you will not exceed the amount you have paid.
